I wrote recently in the local Big Voice publications an outline to what is required from managing agents and landlords regarding these new checks. To double up though I have gone into a little more detail below as to what they new legislation is, why it has been introduced and what to do next below.
As of the 1st of February this year all new tenancies granted are subject to the Governments new Right to Rent checks. The recent news of this obligation set upon managing agents and landlords hasn’t been warmly welcomed by the industry with some commentators having said that the responsibility to check whether a tenant has the right to rent in this country should have been discovered at our boarders. However, the government in their wisdom have imposed this responsibility upon the industry to police. So here’s a very brief outline to the new legislation.
The new checks apply to every new tenant as of the 1st of February 2016.
The managing agent (depending on the agreement you have in place with your agent) or the landlord if no agent is involved. Fines for not carrying out these checks can be in the region of £1,000 per person not checked, rising to £3,000 pp after the first offence. It’s £80/£500 for lodgers – yes these new rules apply to people renting to lodgers too!
Identity checks need to be carried out on each tenant moving into the property and any permitted occupiers over the age of 18. In most cases Right to Rent checks will be fairly straight forward as most tenants will have a British passport. So long as you keep a record of the check and a copy of the passport on file you’ll be fine.
